What is statutory rape, and why?

Troubled Mom asked:

I have a 13 year old daughter who will be 14 in a couple of months, and I have just found out that her "boyfriend" talked her into having sex with him. He is in the 8th grade, 14-15 years old.

What can I do legally? ...

Cynth Answers:

Both parties are below Florida's age of consent (18 years). A charge filed against the boy will NOT fall under statutory rape laws, but under Florida's sexual offender laws.

Whether charges will "stick" depends on how good your lawyer is.
